Terms Of Submissions

This Terms Of Submissions, covers all services provided by MusicCutters.com.

MusicCutters.com is a sub-division of CyberSpaceBroadcasting.com,inc. and falls under the umbrella of the CyberSpaceBroadcasting disclaimer which is Part B of this disclaimer.

MusicCutters.com is a post production editing service that edits music sent in by clients. It does not provide or sell music in any way shape or form. Permission to use all music edited by MusicCutters.com and payment of all royalties is the sole responsibility of the client not MusicCutters.com or any of it's related sub-divisions or it's parent corporation CyberSpaceBroadcasting.com,inc. For Standard Cutting, MusicCutters.com creates a master editing map for each piece of music that comes in. This means that if that same piece of music comes in from another client it will be cut the same way as it was for the first with the exception of it's timeframe constraints. This map keeps the editing time down to a minimum making it possible to charge such an inexpensive editing fee. If a client needs a custom version of that song, that client would need MusicCutters.com to do Custom Cutting on that piece of music at the Custom Cutting price posted on the MusicCutters.com web site price list. Any music sent by a client to MusicCutters.com with the request for Standard Cutting will be handled in the above manner and sent back to the client who must accepted it "as is" with no refund possible for the editing of that music. As editing is an artform, Custom Cutting should have some room for moving the cut point slightly for best sound quality, MusicCutters.com will create what it feels as the best editing for that cut point in the music. If however your need is to adhere Exactly to the cut points you specify regardless of sound quality you must specify this and accept it "as is." At MusicCutters.com's discretion, Custom Cutting problems in the Exact method will be handled fairly to both parties. MusicCutters.com is not responsible for loss or damages "to" or "from" a client and in the clients mishandling of any music. MusicCutters.com is not responsible for and shall not be liable for late, lost, defective, or misdirected music submissions, or unsuccessful efforts to notify a submitting party. If e-mail is returned, not answered, or unable to be sent to the address provided by the submitting party, that submission will be held for 90 days then discarded at MusicCutters.com's sole discretion. MusicCutters.com's web pages contain links to sites on the internet which are owned and operated by third parties. MusicCutters.com is not responsible or imply their endorsement or recommendation for the availability, content, claims, opinions, views, use, and products, processes, trade names, trademarks or services located on or through, any such third-party web site.
Information may be changed or updated without notice. MusicCutters.com will not be liable to any party for any direct or indirect damages related to any use of this web site, or any web site with a Hyperlink connection to or from this one. MusicCutters.com does not assume any legal liability or responsibility for the accuracy, completeness, or usefulness of any information, product, or process disclosed.
Information on this web site is provided without warranty of any kind, either express or implied. This exclusion may not apply to some jurisdictions.
MusicCutters.com cannot be held accountable for the origin or content of any music submission or be responsible for copyright infringements claimed in regards to any music submission.
All decisions will be made at the sole discretion of MusicCutters.com. Music submission for editing to MusicCutters.com constitutes acceptance of all these terms.

By using any CyberSpaceBroadcasting.com,inc. group services, you agree to be bound by the following Terms and Conditions (the "Terms of Service" and the “Terms Of Submissions”). CyberSpaceBroadcasting.com,inc. and it's subdivision MusicCutters.com will from here on be known and referred to as the CyberSpaceBroadcasting.com,inc. group. The organization of people that the CyberSpaceBroadcasting.com,inc. group is providing a website for along with advertisers will from here on be known and referred to as the "client".

Under no circumstances shall the CyberSpaceBroadcasting.com,inc. group be liable to any user on account of that user’s use or misuse of or reliance on the CyberSpaceBroadcasting.com,inc. group services. Arising from any claim relating to this agreement or the subject matter hereof such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence), or otherwise, (even if the CyberSpaceBroadcasting.com,inc. group have been advised of the possiility of such damages). Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the CyberSpaceBroadcasting.com,inc. group services, from inability to use the CyberSpaceBroadcasting.com,inc. group services, or from the interruption, suspension, or termination of the CyberSpaceBroadcasting.com,inc. group services (including such damages incurred by third parties). This limitation shall also apply with respect to damages incurred by reason of other services or goods received through or advertised on the CyberSpaceBroadcasting.com,inc. group services or received through any links provided in the CyberSpaceBroadcasting.com,inc. group services, as well as by reason of any information or advice received through or advertised on the CyberSpaceBroadcasting.com,inc. group services or received through any links provided in the CyberSpaceBroadcasting.com,inc. group services. This limitation shall also apply, without limitation, to the costs of procurement of substitute goods or services, lost profits, or lost data. Such limitation shall further apply with respect to the performance or non-performance of the CyberSpaceBroadcasting.com,inc. group services or any information or merchandise that appears on, or is linked or related in any way to, the CyberSpaceBroadcasting.com,inc. group services. Such limitation shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law.
Some states or other jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations and exclusions may not apply to you.
Without limiting the foregoing, under no circumstances shall the CyberSpaceBroadcasting.com,inc. group be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

We may modify or terminate our services for any reason, and without notice, without liability to you, and/or any other user or any third party. We reserve the right to modify these Terms of Service without notice. Please review these Terms and Conditions from time to time so that you will be apprised of any changes.

Client agrees that it shall defend, indemnify, save and hold the CyberSpaceBroadcasting.com,inc. group harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against the CyberSpaceBroadcasting.com,inc. group, its agents, sponsors, employees, representatives, officers, affiliates, and promotional advisors, that may arise or result from any service provided or performed or agreed to be performed or any product sold by client, its agents, employees, or assigns. Client agrees to defend, indemnify and hold harmless the CyberSpaceBroadcasting.com,inc. group against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with the CyberSpaceBroadcasting.com,inc. groups services; (2) any material supplied by client infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from or through the CyberSpaceBroadcasting.com,inc. group services.

The CyberSpaceBroadcasting.com,inc. group will not be responsible for any damages your business may suffer. The CyberSpaceBroadcasting.com,inc. group Makes no warranties of any kind, expressed or implied for services we provide. The CyberSpaceBroadcasting.com,inc. group disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong deliveries, and any and all service interruptions caused by the CyberSpaceBroadcasting.com,inc. group and its employees and officers. The CyberSpaceBroadcasting.com,inc. group reserves the right to revise its policies at any time.
Client shall not transfer or assign this agreement without prior written consent of the CyberSpaceBroadcasting.com,inc. group. However, the CyberSpaceBroadcasting.com,inc. group may assign the client agreement, in part or in whole, at any time without consent from or notice to the client. The CyberSpaceBroadcasting.com,inc. group reserves right to cancel clients rights under this agreement at any time without further obligation.
Failure to follow any term or condition will be grounds for immediate account deactivation.

The CyberSpaceBroadcasting.com,inc. group reserves the right to revise, amend, or modify this Terms Of Service and all or other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be deemed when the new information is posted within this document or any other online agreements. Clients will not necessarily be notified in writing of these changes. Please check this and all other CyberSpaceBroadcasting.com,inc. group agreements and documents frequently for changes.
